Another day, another mole - Secret legal advice for Barnet Council from Eversheds - New Leak

 I just finished posting the last blog and I get this, from a totally different source.

Hi Roger,
This could follow the previous post (ed note - This post - http://barneteye.blogspot.com/2011/10/barnet-council-confidential-more-secret.html ) where it says they can’t outsource Planning easily. Hey presto the Council received legal Advice from Eversheds LLP which was provided 16 months ago and here is says:


“8.7 The effect of the legislation is that some planning and housing enforcement functions could not be included in contracting out orders, on the basis that they would amount to powers or rights of entry, search and seizure. We would also suggest that functions under the Regulation of Investigatory Powers Act 2000 and the Police and Criminal Evidence Act 1984 would be excluded from the application of section 70 of the Deregulation and Contracting Out Act 1994 on the basis that they would affect the liberty of any individual.”

Barnet Council are spending a lot of tax payers money on expensive big city law firms.When they don’t like the response so go to another company. They then get told exactly the same thing by Trowers and Hamlins. We are all paying for this

In the same legal advice (Eversheds) they looked at these models never saw the light of day

Just take a look at the risks, Borrowing likely to cost more
